Farm Visit Waiver

WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

I agree to the following Waiver of Liability, Assumption of Risk, and Indemnity Agreement ("Agreement") with Indigo Iris Farm, a South Carolina business located at 524 Ridge Rd., Clover, SC 29710 ("Indigo Iris Farm") in consideration and as a condition for allowing me and any minor participants under my supervision entry to participate in any or all of the activities provided on the property of Indigo Iris Farm. These activities include but are not limited to visiting the flower fields, picking flowers, participating in workshops, photography sessions, walking around the property, outdoor events, and other seasonal or recreational activities (collectively referred to as the "Activities").

I enter into this Agreement on my own behalf and on behalf of my children/minor guests, and agree that all provisions shall apply to them. As used in this Agreement, "I" and "my" shall collectively refer to myself, my minor children, and any other minors under my legal supervision.

I expressly AGREE to the following:

Voluntary Participation: I have voluntarily requested to participate in the Activities at Indigo Iris Farm.

Health and Ability: I certify that I and any minors under my supervision are in good physical health and do not have any condition that would interfere with or preclude safe participation in the Activities.

​

Assumption of Risks: I understand and acknowledge that there are inherent and other risks involved in the Activities, including but not limited to uneven terrain, weather conditions, insects, exposure to sun, plants, farm tools, other participants, and natural features of the farm environment. I understand that serious injuries or even death could occur. I freely and voluntarily assume all risks, known and unknown, associated with the Activities.

Waiver/Release/Indemnification: I, on behalf of myself, my heirs, assigns, personal representatives, and any minors listed, voluntarily release, waive, discharge, and hold harmless Indigo Iris Farm, its owners, staff, volunteers, agents, and representatives ("Released Parties") from any and all liability, claims, demands, or causes of action for injury, disability, death, or loss or damage to person or property arising out of or in connection with our participation in the Activities. I agree to indemnify and hold harmless the Released Parties against any and all claims or causes of action brought against them arising from or related to my or my minors’ participation.

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of South Carolina. If any provision is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Severability: If any part of this Agreement is held to be invalid, the rest shall continue in full force and effect. A valid and enforceable clause will be substituted that reflects the original intent as closely as possible.

Parental Consent: If the participant is a minor, I certify that I am the legal parent or guardian of the minor and have authority to sign this Agreement on their behalf. I accept full responsibility for their participation.

I acknowledge that I have read this Agreement, fully understand its terms, and understand that I am giving up substantial rights, including the right to sue. I sign it freely and voluntarily without any inducement.

Under South Carolina law, an agritourism professional is not liable for an injury to or the death of a participant in an agritourism activity resulting from an inherent risk associated with the agritourism activity. (Chapter 53, Title 46, Code of Laws of South Carolina, 1976).
